Terms of service

§ 1 Scope

(1) These General Terms and Conditions (GTC) apply to the purchase agreement for products from Gebrauchsgut's online store between the customer and Gebrauchsgut varo UG (limited liability) (hereafter "Gebrauchsgut").

(2) Any additional agreements are possible but must be confirmed in writing by all parties in advance. The customer may send such confirmation to info@gebrauchsgut.de.

(3) These GTC may be printed or saved electronically.

§ 2 Conclusion of Contract and Payment

(1) The products displayed in the online store at https://www.gebrauchsgut.de/shop are an invitation to make an offer and do not constitute a binding offer from Gebrauchsgut. By submitting an order, the customer makes an offer to purchase. Gebrauchsgut may accept this offer by confirming via email within 7 business days or by shipping the product. No claim exists for acceptance.

(2) Payment is due upon receipt of order confirmation and is prepayment only. Payment information will be provided in the order confirmation.

(3) If Gebrauchsgut cannot accept the customer’s offer (e.g., due to stock issues), the customer will be informed, and any payments will be refunded promptly.

§ 3 Delivery

(1) Delivery times apply from payment receipt. All delivery dates and times are non-binding unless explicitly agreed upon.

(2) If an item is unavailable or cannot be shipped quickly enough, Gebrauchsgut will inform the customer promptly.

(3) Gebrauchsgut delivers per the price list and shipping costs listed in the webshop. Additional shipping requests are available on request, with calculated costs provided. The customer may accept or cancel the purchase.

(4) Partial deliveries may occur when reasonable. Extra shipping costs for partial deliveries are covered by Gebrauchsgut.

§ 4 Transfer of Risk

If the customer is a consumer, Gebrauchsgut bears the shipping risk, regardless of shipping method. For business customers, the risk transfers to the customer once the goods are handed over to the carrier.

§ 5 Warranty and Liability

(1) Warranty:
Statutory warranty rights apply to all goods.

(2) Liability:
(a) Gebrauchsgut is liable for damages caused by intent or gross negligence.
(b) For slight negligence, Gebrauchsgut is only liable for breaches of essential contractual obligations.
(c) Liability under the Product Liability Act remains unaffected.
(d) Liability limitations do not apply to damage to life, body, or health.

§ 6 Right of Withdrawal

Consumers have a right of withdrawal. The period is 14 days from the date the customer or a third party (other than the carrier) took possession of the goods.

§ 7 Data Protection

Gebrauchsgut processes customer data in accordance with legal requirements.

§ 8 Final Provisions

(1) German law applies, excluding UN sales law.
(2) The place of jurisdiction is Berlin if the customer is a business.
